CIVIL DEFENSE WELFARE AND RECREATIONAL CLUB (KERAP)

NAME AND PLACE OF BUSINESS
This club is known as the Civil Defense Welfare and Recreation Club with the abbreviation KERAP. After this it is mentioned KERAP only
Its registered address is the Malaysian Civil Defense Force, Jalan Padang Tembak, Kuala Lumpur or at another place or places to be determined from time to time by the Committee. The place of holding club business cannot be changed without first obtaining permission from the Registrar of Societies.
MEMBERSHIP
- Ordinary Member
- All Civil Defense Headquarters staff are eligible to become Ordinary Members. The application should be sent to the Honorary Secretary who as soon as possible submit it to the Committee for consideration. The Committee may at its discretion reject any application without assigning any reason.
- Associate Member
- All personnel of the Malaysian Civil Defense Force other than at the Civil Defense Headquarters are eligible to become KERAP Associate Members. Associate Members cannot vote and hold any office in KERAP.
- Former personnel of the Civil Defense Force or former KERAP members who change, quit, retire or have left KERAP service or membership can be accepted as Associate Members. The Committee may at its discretion reject any such application without assigning any reason.
Associate Members cannot vote and hold any office in KERAP. Wives or husbands or children of KERAP members aged no more than 18 are eligible to become Associate Members of KERAP but cannot vote or hold any position in the KERAP management Committee. - Children of KERAP members who are over 18 years old and those who are thought to be able to contribute to KERAP can be accepted. They are not eligible to vote or hold any office.
- Honorary Member
- The KERAP committee can appoint several people who have contributed or who have benefited KERAP as Honorary Members. These people do not have the power to vote and cannot hold any position in KERAP.
TERMINATION AND DISMISSAL
1. Members who want to stop being KERAP members must give a written statement two weeks in advance to the KERAP Secretary and pay all their debts.
2. Any member who fails to comply with the law or acts in a way that will defame KERAP’s name may be dismissed or have his membership suspended for a period as the Committee deems reasonable.
3. Before the Committee dismisses or suspends a certain member, the member must be informed of the reasons for the dismissal or suspension in writing. The dismissal or suspension shall be carried out unless the General Meeting postpones or cancels the decision, upon appeal by the member.
OBLIGATIONS OF OFFICE HOLDERS
- The President during his term of office shall be the Chairman of all Agong Meetings and all Committee Meetings and be responsible for the completeness of the proceedings of all meetings. It has a casting vote and must sign the minutes of the meeting when approved. He must sign the minutes of the meeting when approved. He shall sign all KERAP checks along with the Honorary Secretary and Honorary Treasurer.
- The Deputy President shall act as the President in the absence of the President. The Deputy President can sign KERAP’s cheques together with the Honorary Secretary and Honorary Treasurer.
- The Honorary Secretary must carry out KERAP administrative work according to the law and he must carry out the orders of the General meetings and Committee Meetings. He is responsible for managing correspondence and keeping all records. The Honorary Secretary must keep a member register book containing details such as name, age, identity card number, occupation and address of each member. The Honorary Secretary must make minutes of the meeting. The Honorary Secretary must sign all KERAP cheques together with the President or Deputy President and the Honorary Treasurer. The Secretary shall within 28 days from the date of the Annual General Meeting be held send the Regular Annual Statement to the Registrar of Societies as required under section 14 (1) of the Societies Act 1986.
- The Honorary Treasurer is responsible for all KERAP financial matters. He shall make and keep accounts of all financial matters and shall be responsible for their contingencies. He must sign all KERAP cheques together with the President or Deputy President and the Honorary Secretary.
- Other duties and responsibilities of KERAP office holders determined by the President or Deputy President from time to time in relation to any KERAP affairs and administration.
TRUSTEE
- Three Trustees who are over 21 years of age must be appointed in the Annual General Meeting and they will serve for as long as KERAP requires. They will be entrusted with all property belonging to KERAP by signing a trust deed.
- Trustees may not sell, withdraw or exchange property belonging to KERAP without the consent and authority given by the KERAP General Meeting.
- A Trustee may be removed from his position by the General Meeting for reasons of infirmity due to illness, insanity, not being in the state or for other reasons that cause him to be unable to carry out his duties or work satisfactorily. If there is a death, resignation or removal of a newly appointed trustee in the General Meeting.
PROHIBITION
- The games mentioned below cannot be played inside KERAP: Rouleete, Latto Fan Tan, Poh Peh Bin, Belangkai, Pai Kau, Tau Ngau, Tien Kow Chan Ji Kee, Sam Cheong, Dua Puluh Satu, Tiga Puluh Satu, Sepuluh dan Setengah, semua permainan dadu, banker’s game dan semua permainan yang bergantung kepada perjudian.
- KERAP or its members shall not attempt to prevent or in any way interfere with business or the prices of goods or take part in trade union movements as described in the Trade Union Ordinance 1959.
- The club cannot conduct lotteries whether reserved for members or not, in the name of KERAP or its officers or Committee or members without approval from the relevant authorities.
- The benefits as described under the sections of the Societies Act, 1966 cannot be given to KERAP to any member of KERAP.
EMBLEMS AND FLAGS

- The KERAP emblem is a yellow circle surrounding the Civil Defense symbol inside with the WELFARE AND RECREATION CLUB (KERAP) surrounding the circle while the word PERTHANAN AWAM is placed at the base of the logo.
- The KERAP flag is pure white with the KERAP logo in the middle.
AFFILIATE CLUB
Any Club established by the Branch Offices of the Malaysian Civil Defense Force can apply to join KERAP. The committee may accept or reject each application without giving any reason. Affiliated Clubs do not have the power to vote in any KERAP Meeting but may use or enjoy all facilities provided by KERAP or otherwise.
GENERAL MEETING
- The General Meeting is the highest authority in this KERAP. At least one half of the number of members entitled to vote or twice the number of Committee members (whichever is less) must be present in the General Meeting to confirm the number (quorum) for the meeting.
- If the quorum is not sufficient after half an hour from the time set for the meeting then the meeting shall be adjourned to a date (not more than 30 days) set by the Committee and if the quorum is not sufficient after half an hour from the time set for the adjourned meeting then the authority the members who are present run the meeting but do not have the power to change the KERAP’s law and make decisions that involve all members.
- The Annual General Meeting for KERAP shall be held as soon as possible after the end of the financial year but no later than April 30 at the date, time and place determined by the Committee. The work of the Annual General Meeting is:
- Received the Committee’s report on the works that had been audited for the past year.
- Received the Treasurer’s report and audited Statement of Accounts for the past year.
- Appointing Committee members and Auditors for the next two years.
- Manage other matters presented in the meeting.
- The Honorary Secretary must send to each member at least 7 days before the Annual General Meeting is held an agenda (meeting event) including copies of meeting reminders, reports, proposals (if any) and statements of KERAP’s account for last year which has been audited, a copy of this letter must also be provided to be read by members at the registered address or at the KERAP meeting place.
- Extra Ordinary General Meeting for this Club can be held:

- When deemed necessary by the Committee, or
- At the request of not less than 50 percent, ordinary KERAP members by explaining the purposes and reasons for holding it.
- Extra Ordinary General Meetings requested by members must be distributed by the Honorary Secretary to all members at least 14 days before the date set for the meeting. The management and agenda for the Extra Ordinary General Meeting shall be distributed by the Honorary Secretary to all members at least 14 days before the date set for the meeting. Paragraphs 8.1 and 8.2 in this constitution regarding the adjournment quorum for an extra ordinary meeting but with the condition that if the quorum is not sufficient after half an hour from the time set for the Extra Ordinary General Meeting at the request of the members then the meeting shall be canceled and within 6 months from this date Extra Ordinary General Meeting at the request of members with the same purpose cannot be held.
FINANCE
- Subject to the following provisions of this law, this KERAP money can be used for beneficial things to carry out the purposes of KERAP including administrative expenses, financing and expenses of KERAP activities but cannot be used to pay the fines of members sentenced in court.
- The Honorary Treasurer is allowed to keep petty cash no more than RM3,000.00 at any one time. Money in excess of that amount must be deposited in a bank approved by the Committee. The bank statement must be in the name of KERAP.
- All checks or statements of money withdrawals from KERAP must be signed with the President or Deputy President, Honorary Secretary and Honorary Treasurer. Due to the absence of the President, Honorary Secretary or Honorary Treasurer, the Committee may appoint any of them as a substitute to sign KERAP checks or statements of disbursement.
- All KERAP expenses must be approved by the Committee. However, a KERAP contingency expenditure can be approved by the President or the Deputy President. Expenses of less than RM200.00 for a certain period of time can be approved by the Honorary Treasurer. These expenses must be informed and confirmed in the following Committee Meeting.
- A statement of money received and spent together with a balance sheet for the year shall be prepared by the Treasurer and examined by the Auditor in accordance with Rule 12, as soon as possible after the end of the financial year. The audited balance sheet must be submitted for approval at the following Annual General Meeting and a copy must be provided for members’ information at the registered address or at the KERAP meeting place.
- The KERAP financial year starts from January 1 and ends on December 31 each year.
INTERPRETATION OF LAWS AND REGULATIONS
- Between the general meeting, the Committee can give its interpretation to this law and when necessary decide matters that are not contained in the law.
- Except for matters that are contrary or inconsistent with the policy that has been made in the General Meeting, the Committee’s decision on members is final if not changed by the General Meeting decision.
AMENDMENTS TO LAWS AND REGULATIONS
- These laws and regulations cannot be changed or amended except by the decision of the General Meeting. Applications for changes or amendments to these laws and regulations must be made to the Registrar of Societies within 28 days from the date of the decision to make the change or take effect from the date the changes and amendments are approved by the Registrar of Societies.
PURPOSE AND MEANING
- To provide the necessary opportunities and facilities for members in the field of sports, literature, culture and promote goodwill and mutual respect.
- To help in the welfare and welfare of members and their families.
- To buy, rent or otherwise obtain movable or immovable property and any rights or privileges deemed necessary that may be a necessity or convenience for KERAP or members of KERAP and to repair, manage, sell, rent, lease , release, put into account or otherwise with all or any part of the KERAP property.
- To affiliate with any legitimate Organization that has the same or similar objectives in whole or in part.
ENTRY FEES, FEES AND OTHER CHARGES
- Ordinary Member
- Entrance Fee : RM 2.00 per member
- KERAP members must pay Club fees to the Treasurer with fee payments made four (4) times a year (representing 3 monthly collections with collection months falling in January, April, July and October) on or before the 15th. collection month as follows:

- Members who do not pay monthly fees for more than six (6) months are not eligible to vote or hold any office and receive/claim any contribution provided by KERAP.
- Associate Membership
- Entry Fee : Free
- Annual Fee : RM 10.00
- Associate members as per rule 4.2.3 are free.
- Affiliate Club
- Entrance Fee: RM 20.00
- Annual Fee of RM 30.00 for each Affiliated Club
- Honorary Member
- Will be asked to contribute at the discretion of the Committee KERAP.
- Special fees or collection of money from members for certain matters can be carried out with the approval of the Committee Members Meeting. If there is a member who fails to pay the dues within the stipulated time, then the money will be considered the same as the monthly dues.
COMMITTEE
- The KERAP committee is as follows:
- A President
- A Deputy President
- An Honorary Secretary
- An Honorary Treasurer
- 7 Ordinary Committee Members elected in the General Meeting
- KERAP’s President can appoint no more than 2 additional Committee Members if deemed necessary.
- The holders of this KERAP position and every officer who carries out the government duties of this KERAP must be Malaysian citizens.
- The Director General of Malaysian Civil Defense is automatically appointed as an Advisor. The position of Yang Dipertua is automatically assumed by the individual who holds the position of Deputy Director General (Operations). Other Committee Members mentioned above must be proposed, supported and elected according to the majority of votes in the Annual General Meeting (when the term is complete as stipulated in rule 8.3 (c). All officers can be reappointed every two years.
- The job of the Committee is to manage and organize the daily work of KERAP and to make decisions on matters regarding KERAP’s journey without deviating from the general policy set by the General Meeting. The Committee should not be able to make a decision contrary to the decision of the General Meeting without first communicating with it and the Committee must always obey the decision of the General Meeting. The committee must report on its activities in the past year to each annual General Meeting.
- The committee must meet at least once in 3 months. The announcement of each meeting must be given to members 7 days in advance. The President alone, or no less than 4 members of the Committee can call for a Committee Meeting to be held at any time. At least half of the number of Committee members must be present to confirm the trip and satisfy the quorum of the meeting.
- If an important matter arises that requires the approval of the Committee and the Committee Meeting cannot be held, then the Honorary Secretary can obtain approval from the Committee Members with a Circular Letter. The following conditions may be deemed to have been accepted:
- The problems raised should be detailed clearly in the Circular Letter sent to the Committee Members;
- At least half of the number of Committee Members must express their agreement or objection to the proposal and
- The decision shall be by majority vote. Any decision found through the Circular Letter must be reported by the Secretary to the Committee Meeting later to be confirmed and noted in the meeting reminder.
- Committee members who fail to attend Committee Meetings three times in a row without a reasonable reason will be deemed to have resigned from the Committee.
- If a Committee Member dies or changes or resigns, the candidate with the second highest number of votes in the previous election shall be called to fill the vacancy. If such a candidate is not available or rejects the position, then the Committee has the authority to appoint another KERAP member to fill the vacancy until the Annual General Meeting is held.
- The Committee may give instructions to the Honorary Secretary or other officers to carry out KERAP affairs and appoint management and staff as deemed necessary. It can suspend or remove from office any management or staff for negligence in the job, cheating, incompetence, disobeying the Committee’s decisions, or for reasons considered to be damaging to KERAP.
- The Committee can establish Sub-Committees if deemed necessary and give special duties to any Committee Member.
AUDITORS
- The Committee may appoint a person it deems fit as an Honorary Auditor. Another person who is not a post holder for two years and can be reappointed. If a vacancy occurs, the President has the authority to appoint any KERAP member to fill the vacancy.
- Auditors are required to check KERAP accountsfor a year and make a report or confirmation for the General Meeting. They should also be required at any time by the President to audit KERAP for any time during their term of office and make a report to the Committee.
PATRON
The General Meeting or KERAP Committee may decide to appoint one or several suitable dignitaries as KERAP Patrons.
DISSOLUTION
- These laws and regulations cannot be changed or amended except by the decision of the General Meeting. Applications for changes or amendments to these laws and regulations must be made to the Registrar of Societies within 28 days from the date of the decision to make the change or take effect from the date the changes and amendments are approved by the Registrar of Societies.
- If KERAP is to be dissolved in the manner mentioned above, then all debts and liabilities of KERAP that are legal according to law must be settled in the manner agreed upon in the General Meeting.
- The statement of conviction with the dissolution must be submitted to the Registry of Organizations within 14 days from the date of the dissolution.
